By Debbie LaChusa There’s a marketing concept called a SWOT Analysis. Sounds pretty daunting doesn’t it? Well, don’t worry it’s not. It’s actually very simple. And it’s something that can make or break your business. What is SWOT? It stands for Strengths, Weaknesses, Opportunities and Threats. What do you do with it? You use it to size-up your current situation with your business so you can create a plan to be successful. Ask yourself the following questions BEFORE you start marketing: (1) What are your Strengths? What do you do well? What characteristics do you have that will help you be successful in business? What relevant experience do you have? Size up all the strengths you bring to your business. (2) What are your Weaknesses? Now it’s time to play the other side of the card. What weaknesses do you have that could negatively impact your ability to be successful in your business? Lack of experience? Lack of capital to support the growth of the business? Lack of knowledge? Make a list of all your weaknesses. (3) What Opportunities do you see? What’s going on in the marketplace, or in your industry or business category, that could create an opportunity for your business? A niche that is not being covered? An audience that is not being addressed? Uncover all the opportunities available to you. (4) What Threats do you see? Time to play the other side again. What’s going on in the marketplace or your industry that could threaten your ability to be successful? Are there a lot of competitors? Do they have deeper pockets or a better product or service? Is the economy on a downward trend? Be aware of all potential threats to your business success. There you have it. You’ve just done a SWOT Analysis for your business. The information you’ve uncovered can mean the difference between business success, or struggle and failure. Being prepared BEFORE you go into business, or before you start marketing is a critical step in building a successful business. Knowing challenges you might face allows you to prepare, overcome or take a different path. And capitalizing on your strengths and the opportunities available to you will make your journey more enjoyable and more fruitful. FTC Requires Companies To Destroy Consumer Records

By Richard Chapo On June 1, 2005, the Federal Trade Commission issued new regulations requiring companies to destroy certain consumer records. The specific rule requires consumer information such as credit reports to be physically destroyed after it is used. Records The rule covers practically any consumer records. Examples include credit reports, court records, employment histories and rental histories to mention only a few. Identity Theft Heading complaints from constituents, Congress has been trying to figure out how to deal with growing identity theft problems. In response, the FTC rule requires all personal information to be: 1. Burned(!), 2. Pulverized, 3. Shredded, or 4. Destroyed. Whether you shred the records or stand in the parking lot with a flamethrower, the rule requires the documents to be destroyed to the extent they cannot be read. Importantly, the rule also applies to electronic files. As an agency rule, the new regulation does not result in any criminal penalties. Instead, the FTC penalty provisions call for a fine of up to $2,500 per violation. Individuals that have information misused can also seek damages in civil lawsuits. Effective? The FTC should be applauded for taking any step to help in the fight against identity theft. The flood of recent public disclosures by companies admitting to lost records is appalling. But does this new rule really help? No. The new regulation provides no provisions on how long the records can be held before being destroyed. This effectively neuters the regulation. Any claim of violation is going to be refuted by the defense of, We destroy records every xxx months. Even if you disagree with this assessment, consider the destruction of electronic files. Electronic files are automatically backed up on hard drives. Merely deleting a file does not erase it from a hard drive. To comply with the regulations, are companies supposed to wipe all their hard drives every day or is deleting the records enough? Wiping the drives is incredibly burdensome while deleting files is useless. As you might imagine, the FTC provides no guidance on the issue. Cutting to the chase, the FTC has issued this rule for one reason to satisfy Congress. It has little practical impact in protecting your private information and leaves companies with another vague regulatory requirement. Other obvious forms of retaliation include refusal to hire, denial of job benefits, denial of promotion, demotion, and suspension. Other kinds of adverse actions include: threats, reprimands, harassment, negative evaluations, or other adverse treatment of employees. Title VII of the Civil Rights Act of 1964, [FN1] the Age Discrimination in Employment Act, [FN2] the Americans with Disabilities Act, [FN3] and the Equal Pay Act [FN4] prohibit retaliation by an employer, employment agency, or labor organization because an individual has engaged in protected activity. [FN5] Protected activity, as defined, consists of the following: (1) opposing a practice made unlawful by one of the federal employment discrimination laws (based on the “opposition” clause); or (2) filing a charge, testifying, assisting, or participating in any manner in an investigation, proceeding, or hearing under the applicable federal law (based on the “participation” clause). [FN1] Section 704(a) of Title VII, 42 U.S.C. 2000e-3(a).[FN2] Section 4(d) of the ADEA, 29 U.S.C. 623(d).[FN3] Section 503(a) of the ADA, 42 U.S.C. 12203(a). Section 503 (b) of the ADA, 42 U.S.C. 12203(b), further provides that it is unlawful “to coerce, intimidate, threaten, or interfere with any individual in the exercise or enjoyment of, or on account of his or her having exercised or enjoyed, or on account of his or her having aided or encouraged any other individual in the exercise or enjoyment of, any right granted or protected by this chapter.”[FN4] Section 15(a)(3) of the Fair Labor Standards Act (FLSA), 29 U.S.C. 215(a)(3).[FN5] Federal employees are also protected against retaliation under each of the employment discrimination statutes. See, e.g., Hale v. Marsh, 808 F.2d 616, 619 (7th Cir. 1986) (recognizing retaliation cause of action for federal employees under Title VII); Bornholdt v. Brady, 869 F.2d 57, 62 (2d Cir. 1989) (recognizing retaliation cause of action for federal employees under ADEA). The U.S. Equal Employment Opportunity Commission (EEOC) has a policy of ensuring that individuals who (1) oppose unlawful employment discrimination, (2) participate in employment discrimination proceedings, or (3) otherwise assert their rights under the laws enforced by the EEOC are protected against retaliation. Voluntary compliance with the anti-discrimination laws and effective enforcement of those laws depend in large part on two things: (1) on the initiative of individuals to oppose employment practices that they reasonably believe to be unlawful, and (2) to file charges of discrimination. If employer retaliation for employees’ oppositional or participatory activities were permitted to go un-remedied, it would have a chilling effect upon the willingness of individuals to speak out against employment discrimination or to participate in the Commission’s (EEOC’s) administrative process or in other employment discrimination proceedings. Retaliation claims are processed by the EEOC’s administrative review process, either separately or in combination with local human rights commissions or agencies. The EEOC generally will try to encourage a resolution between the parties through mediation. Employees who have been subjected improperly to termination are, by law, to be restored to their jobs. The Commission can sue for temporary or preliminary injunctive relief before completing its processing of a retaliation charge if the charging party or the Commission likely will suffer irreparable harm due to of the retaliation.
